These General Terms and Conditions (GTC) apply to the use of the platform demotape.app as well as to all contracts concluded between the operator (hereinafter "provider") and the users.
The offer is aimed at both consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB).
demotape.app is a web-based Software-as-a-Service (SaaS) that provides functions for storing, managing, analyzing (e.g. LUFS measurement), comparing and sharing audio files.
The specific scope of functions depends on the chosen tariff (Free or Pro).
The provider is entitled to technically further develop or adapt functions, provided this is reasonable for the user.
The presentation of the services on the platform does not represent a legally binding offer.
A contract for a free account is concluded upon completion of registration.
A contract for a paid subscription is concluded when the user clicks on the button "Subscribe now with obligation to pay", successfully completes the payment process and receives a confirmation email.
With the confirmation email, the user receives a summary of the contract data as well as these GTC.
Paid "Pro" subscriptions with monthly or annual terms are offered.
After cancellation, the account is automatically downgraded to the Free tariff.
If stored content exceeds the limits permitted in the Free tariff, older content will be marked.
The user receives a period of 30 days for adjustment or renewed upgrade. After this period has expired, excess content will be irretrievably deleted.
To use the service, you must create a user account. The user is obliged to provide truthful information and to treat their access data confidentially.
As an alternative to traditional registration, we offer login via third-party providers (Google Login, Apple Login). In this case, the terms of use and data protection guidelines of the respective provider also apply.
The provider reserves the right to temporarily or permanently deactivate, block, or delete user accounts if the user violates these GTC, legal regulations, or the rights of third parties. This applies in particular to the unauthorized upload or distribution of copyrighted material (such as music tracks or artwork for which the user does not hold the necessary rights), the misuse of the platform, or other illegal activities. In the event of a suspension or termination, the user will be notified via email.
The user remains the owner of all rights to uploaded content.
Content is stored as long as it is actively available in the account.
Content is irretrievably deleted upon:
The provider strives for high availability, but does not guarantee uninterrupted use.
Maintenance work or technical faults can cause temporary restrictions.

Consumers are generally entitled to a statutory right of withdrawal of 14 days.
In the case of digital services, the right of withdrawal expires prematurely if the user expressly agrees that execution of the contract begins before the expiry of the withdrawal period and confirms that they thereby lose their right of withdrawal.

The provider is liable without limitation for intent, gross negligence and damage resulting from injury to life, body or health.
In the event of slight negligence, the provider is only liable for the violation of essential contractual obligations and limited to the contract-typical, foreseeable damage.
Liability for data loss only exists if the user has created appropriate backup copies.
For free accounts and services, the provider's liability is limited to intent and gross negligence according to the statutory provisions of donation law (§ 521 BGB).
The provider is entitled to further develop or adapt services.
Price changes will be announced at least 30 days before they take effect. In the event of an objection, there is a special right of termination.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
If the user is a merchant, the place of jurisdiction is the seat of the provider.
Should a provision of these GTC be invalid, the validity of the remaining provisions remains unaffected.
